  THIS INSPECTION WAS DONE IN RESPONSE TO A COMPLAINT RECEIVED 12/08/2010. THE COMPLAINANT
  STATED THAT THERE IS A MATTRESS, TRASH, AND RUBBISH IN THE BACK OF THE BUILDING. THE PERSON IN
   CHARGE WAS NOT AWARE OF THE COMPLAINT BUT STATED THAT SOMEONE IN THE AREA HAD DUMPED THE
  MATTRESS AND RUBBISH ON THEIR PROPERTY. THE PERSON IN CHARGE STATED THAT THEY WOULD NOTIFY THE
  OWNER TO HAVE THE MATTRESS AND RUBBISH PICKED UP BY THEIR WASTE MANAGEMENT COMPANY. THE
  VIOLATION IS NOTED BELOW ALONG WITH OTHER VIOLATIONS NOTED DURING THE REGULAR INSPECTION.
   
  OBSERVED A BULK FOOD CONTAINER OF UNPACKAGED CAKE MIX OR FLOUR THAT WAS NOT LABELED WITH THE
  COMMON NAME OF THE FOOD. PROPERLY LABEL ALL CONTAINERS OF UNPACKAGED FOODS THAT ARE NOT
  UNMISTAKABLY IDENTIFIABLE WITH THE COMMON NAME OF THE FOOD.
   
  3717-1-03.2 Food: Protection from Contamination after Receiving
   
  (D)      Food storage containers - identified with common name of    food.
   
        Working containers holding food or food ingredients that are removed from their original packages for use in a food
       service operation or retail food establishment, such as cooking oils, flour, herbs, potato flakes, salt, spices,
       and sugar shall be identified with the common name of the food except that containers holding food that can be
       readily and unmistakably recognized such as dry pasta need not be identified.

  OBSERVED A BUILDUP OF MOUSE FECES AT THE BOTTOM OF METAL CABINETS ALONG THE WALLS. OBSERVED A
  BUILDUP OF FOOD AND OTHER RESIDUE ON WALK IN COOLER FLOOR AND WALK IN CANDY COOLER ESPECIALLY
  UNDER EQUIPMENT. OBSERVED A BUILDUP OF BATTER INSIDE PROOF BOX WHICH WAS CAUSING A FOUL
  ODOR. ALSO, OBSERVED A BUILDUP OF FOOD AND OTHER RESIDUE ON OUTSIDE OF BULK FOOD CONTAINERS,
  INSIDE AND OUTSIDE OF REACH IN COOLER, AND ON CAN OPENER BLADE. CLEAN ALL EQUIPMENT AS OFTEN AS
  NECESSARY TO MAINTAIN CLEAN TO SIGHT AND TOUCH.
   
  3717-1-04.5 Equipment, Utensils, and Linens:  Cleaning of    Equipment and Utensils
   
  (A)      Equipment, food-contact surfaces, nonfood-contact surfaces,    and utensils.
   
       (1)      Equipment food-contact surfaces and utensils shall be clean to sight and touch.
   
        (2) The food-contact surfaces of cooking equipment and pans shall be kept free of encrusted grease deposits and
       other soil accumulations.
   
        (3) Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and
       other debris.

  OBSERVED BOXES / BAGS OF SINGLE SERVICE LIDS, FOIL CONTAINERS, COOKIE CUTTERS AND OTHER FOOD
  EQUIPMENT STORED ON THE FLOOR. STORE ALL SINGLE SERVICE ITEMS AND FOOD EQUIPMENT AT LEAST SIX
  INCHES OFF THE FLOOR TO PREVENT CONTAMINATION FROM THE PREMISES.
   
  3717-1-04.8 Equipment, Utensils, and Linens:  Protection of Clean Items
   
  (E)      Equipment, utensils, linens, single-service articles, and    single-use articles - storage.
   
        (1) Cleaned equipment and utensils, laundered linens, single-service articles, and single-use articles shall be
       stored:
   
            (a)      In a clean, dry location;
   
            (b)      Where they are not exposed to splash, dust, or other    contamination; and
   
             (c) At least six inches (fifteen centimeters) above the floor unless the items are kept in closed packages
            on dollies, pallets, racks, and skids that are designed as specified under paragraph (II) of rule 3717-1-04.1
            of the Administrative Code.
   
        (2) Clean equipment and utensils shall be stored as specified under paragraph (E)(1) of this rule and shall be
       stored:
   
            (a)      In a self-draining position that allows air drying; and
   
            (b)      Covered or inverted.
   
        (3) Single-service and single-use articles shall be stored as specified under paragraph (E)(1) of this rule and
       shall be kept in the original protective package or stored by using other means that afford protection from
       contamination until used.

  OBSERVED AREAS OF WOOD FLOOR WHERE FLOOR WAS MISSING, WARPED, BROKEN OR OTHERWISE IN DISREPAIR
  ESPECIALLY IN KITCHEN UNDER THE PREP TABLES LOCATED NEAR THE DISHWASHER AND NEAR THE FURNACE AT
  FRONT COUNTER / SALES AREA. REPAIR FLOORS AS NECESSARY SO THAT THEY ARE SMOOTH, NON ABSORBENT
  AND EASILY CLEANABLE.
   
  OBSERVED PEELING / CRACKING PAINT ON AND NEAR RESTROOM PARTITIONS AND ON CEILING IN RESTROOM /
  STORE ROOM IN BASEMENT. REPAIR AND REPAINT WALLS AND CEILINGS AS NECESSARY SO THAT THEY ARE
  SMOOTH, NON ABSORBENT AND EASILY CLEANABLE.
   
  3717-1-06 Physical Facilities:  Materials for Construction and    Repair
   
  (A)      Indoor areas - surface characteristics
   
        (1) Except as specified in paragraph (A)(2) of this rule, materials for indoor floor, wall, and ceiling surfaces
       under conditions of normal use shall be:
   
             (a) Smooth, durable, and easily cleanable for areas where food service operation or retail food establishment
            activities are conducted;
   
            (b)      Closely woven and easily cleanable carpet for carpeted    areas; and
   
             (c) Nonabsorbent for areas subject to moisture such as food preparation areas, walk-in refrigerators,
            warewashing areas, toilet rooms, mobile food service operation or mobile retail food establishment servicing
            areas, and areas subject to flushing or spray cleaning methods.
   
       (2)      In a temporary food service operation or temporary retail    food establishment:
   
             (a) A floor if graded to drain, may be concrete, machine-laid asphalt; or dirt or gravel if it is covered
            with mats, removable platforms, duckboards, or other approved materials that are effectively treated to control
            dust and mud; and
   
             (b) Walls and ceilings may be constructed of a material that protects the interior from the weather and
            windblown dust and debris.

  OBSERVED A BUILDUP OF MOUSE DROPPINGS ON FLOOR AND AROUND EDGES OF THE FLOOR IN KITCHEN.
  OBSERVED BATTER RESIDUE BUILDUP ON FLOOR AND WALL NEAR DONUT MAKER. ALSO, OBSERVED A BUILDUP
  OF RESIDUE ON FLOOR UNDER WAREWASHING MACHINE. GENERAL FLOOR CLEANING NEEDS IMPROVEMENT
  ESPECIALLY UNDER AND BEHIND EQUIPMENT. CLEAN THE PHYSICAL FACILITIES AS OFTEN AS NECESSARY TO
  MAINTAIN CLEAN.
   
  3717-1-06.4 Physical Facilities:  Maintenance and Operation
   
  (B)      Cleaning - frequency and restrictions.
   
       (1)      The physical facilities shall be cleaned as often as    necessary to keep them clean.
   
        (2) Cleaning shall be done during periods when the least amount of food is exposed such as after closing. This
       requirement does not apply to cleaning that is necessary due to a spill or other accident.

  OBSERVED BLACK STAINING AND / OR A BUILDUP OF GREEN CLUMPS IN TOILETS IN RESTROOMS OR STORE
  ROOM IN BASEMENT. ALSO, OBSERVED AN ACCUMULATION OF DEBRIS AND RESIDUE IN SHOWER IN RESTROOM /
  STORE ROOM IN THE BASEMENT. MAINTAIN ALL PLUMBING FIXTURES IN A CLEAN AND SANITARY CONDITION.
  IF THEY CAN NO LONGER BE CLEANED THEY SHOULD BE REMOVED OR REPLACED AS NECESSARY TO ACHIEVE
  COMPLIANCE.
   
  3717-1-06.4 Physical Facilities:  Maintenance and Operation
   
  (H)      Cleaning and maintenance of plumbing fixtures.
   
        Plumbing fixtures such as handwashing sinks, toilets, and urinals shall be cleaned as often as necessary to keep them
       clean and maintained.

  OBSERVED MOUSE DROPPINGS ALONG FLOOR EDGES AND IN FLOOR CABINETS ALONG WALLS. OBSERVED
  GENERAL CONDITIONS THAT AID IN RODENT HARBORAGE SUCH AS INSUFFICIENT CLEANING, A BUILDUP OF
  CLUTTER, ETC.
   
  ACCORDING THE PERSON IN CHARGE, CENTRAL EXTERMINATING CO. TREATS THE FACILITY FOR PESTS AT THE
  BEGINNING OF THE MONTH. A COPY OF THE RECEIPT FROM OCTOBER WAS PROVIDED. THE PERSON IN CHARGE
  STATED THAT THE EXTERMINATOR VISITED THE FACILITY ON FRIDAY, DECEMBER 3, 2010 BUT HE COULD NOT
  LOCATE THE RECEIPT.
   
  IN ADDITION TO HAVING A PEST CONTROL COMPANY SPRAY AND SET TRAPS, GENERAL CLEANING, SANITATION,
  AND ORGANIZATION SHOULD BE IMPROVED TO ELIMINATE RODENT HARBORAGE CONDITIONS. ALSO, THE
  FACILITY SHOULD REGULARLY INSPECT THE FACILITY FOR HOLES IN THE STRUCTURE / WALLS AND FILL IN
  TO LIMIT THE ABILITY OF RODENTS / INSECTS TO TRAVEL THROUGH THE BUILDING. THE PRESENCE OF
  RODENTS AND INSECTS MUST BE MINIMIZED USING AN EFFECTIVE PEST MANAGEMENT PROGRAM.

  (K)      Controlling pests.
   
       The presence of insects, rodents, and other pests shall be    controlled to minimize their presence on the premises by:
   
       (1)      Routinely inspecting incoming shipments of food and    supplies;
   
       (2)      Routinely inspecting the premises for evidence of pests;
   
        (3) Using methods, if pests are found, such as trapping devices or other means of pest control as specified under
       paragraphs (C), (K) and (L) of rule 3717-1-07.1 of the Administrative Code; and
   
       (4)      Eliminating harborage conditions.

  OBSERVED LITTER INCLUDING A MATTRESS AND OTHER MISCELLANEOUS REFUSE ITEMS THAT WERE DUMPED
  BEHIND THE BUILDING NEAR THE DUMPSTER.
   
  ALSO, OBSERVED BROKEN / UNNECESSARY EQUIPMENT STORED AT THE FACILITY. REMOVE ALL LITTER AND
  BROKEN OR UNNECESSARY EQUIPMENT FROM THE PREMISES AS OFTEN AS NECESSARY TO MAINTAIN THE
  PREMISES FREE OF LITTER AND UNNECESSARY ITEMS.
   
  3717-1-06.4 Physical Facilities:  Maintenance and Operation
   
  (N)      Maintaining premises - unnecessary items and litter.
   
       The premises shall be free of:
       
        (1) Items that are unnecessary to the operation or maintenance of the food service operation or retail food
       establishment such as equipment that is nonfunctional or no longer used; and
   
       (2)      Litter.

  ALL COOLERS WERE COLD HOLDING BELOW 41F.
   
  GLOVES, CHLORINE SANITIZER AND TEST KIT WERE PROVIDED.
   
  NOTE:
   
       -OBSERVED TAPE USED ON PROOF BOX TO HOLD IN HEAT. REMOVE  TAPE   AS IT IS NOT SMOOTH, NON
        ABSORBENT AND EASILY CLEANABLE AND  SEAL PROOF BOX WITH A FOOD   GRADE CAULK OR OTHER
        SEALANT.
   
       -OBSERVED COOKIES PACKAGED ON-SITE OFFERED FOR CONSUMER   SELF-SERVICE WITHOUT PROPER
        INGREDIENT LABELS AND OTHER REQUIRED LABELING. THE ISSUE WAS   DISCUSSED WITH THE 
        PERSON IN CHARGE AND THE COOKIES WERE PLACED BACK BEHIND THE COUNTER SO THAT THEY 
        WERE NO LONGER CONSUMER SELF-SERVICE. ALL FOODS PACKAGED ON-SITE, MADE OF MORE THAN 
        ONE INGREDIENT AND OFFERED FOR CONSUMER SELF SERVICE MUST BE PROPERLY LABELED WITH
        INGREDIENTS AND ALL FOOD PACKAGED ON-SITE AND OFFERED FOR CONSUMER SELF SERVICE MUST
        BE PROPERLY LABELED WITH THE MANUFACTURER'S INFORMATION, THE COMMON NAME OF THE
        FOOD AND ANY OTHER APPLICABLE INFORMATION REQUIRED IN THE OHIO ADMINISTRATIVE CODE.
